By making a booking at this property you agree to the below terms:
RATES
All rates quoted on this site are subject to availability. By using the rates quoted on this site you agree with and abide by these Terms and Conditions. Rates as quoted are per night on a cottage the only basis, unless specified. Rates may increase without notice due to any changes in or the imposition of government charges, taxes or levies. Guests will be notified where possible of any increases.
PAYMENT
Full payment is required at the time of booking. Heartwood Farm Byron Bay will accept payment by Electronic Funds Transfer (EFT), Credit Card and PayPal.
CANCELLATION POLICY
If you cancel your booking 30 days or more prior to your scheduled arrival at Heartwood Farm Byron Bay, there will be no charge, except for any credit card surcharges. If cancelled or modified within 30 days the full tariff is payable.
If you cancel your booking 60 days or less for our peak periods, which includes Music Festivals, Easter, Christmas and the New Year’s Period (19 December to 10 January) the full tariff is payable.
Where possible when a cancelation has to be made, management can at their discretion, and there is no obligation to do so, attempt to relet the property and if successful then a full refund will be made available.
If you are required to cancel due to Coronavirus-related events such as border closures or travel limitations enforced by authorities, we will offer a free date change or a credit for a future stay or provide a refund, except for any credit card surcharges.
The owner reserves the right to make alterations or cancelations to bookings due to unforeseen circumstances and cannot be held responsible for any loss or damages or inconvenience caused to a guest as a result of an alteration or cancelation to a booking.
CHECK-IN/CHECK OUT
Check-in time is 3.00 pm and check out is 10.00 am. We will try our best wherever possible to accommodate early arrival and/or late departure. Please understand this is not always possible.
BEHAVIOUR, NO PARTY AND NOISE POLICY
We are located in a rural neighbourhood, with close neighbours (even if you can’t see them they are there). Please respect our neighbours and keep noise to a minimum. Unreasonable noise will not be tolerated after 10.00 pm, i.e. loud music, shouting, screaming etc. A charge of $500 will apply if management deems it necessary to ask guests to cease unreasonable noise after 10.00 pm, or if there are any noise complaints from neighbours. Heartwood Farm Byron Bay has a “No Party” policy unless it is an event that has been pre-arranged and permitted by the owners. We reserve the right to request people who are making too much noise at any time of the day or night to leave. No refunds will be applicable. A security company or the police may be called to investigate complaints of excessive noise or anti-social behaviour. Any charges incurred by the security company or police will be charged to the credit card provided as security for the booking.
In accordance with the Byron Bay Shire Council’s Short Term Rental Accommodation Action Plan, there is to be no more than 6 ‘ non-staying guests on the property between the hours 8 am and 11 pm. No ‘non-staying guests are permitted between 11 pm and 8 am.
SCHOOLIES POLICY
Heartwood Farm Byron Bay does not accept schoolies reservations.
ADDITIONAL CHARGES
Management also reserves the right to charge guests for the following, but not restricted to, all damages and breakages, lost keys, missing items, late departure, extra cleaning and unpaid expenses. Any additional charges will automatically be deducted from the security bond.
Normal breakage such as a glass or a plate will not be charged to you. Please leave a note for the cleaner so we can replace any item(s).
CLEANING
Heartwood Farm Byron Bay should be left essentially as you found it – we understand that it will become ‘lived in’ whilst you are there, but leaving it in an outright mess will incur additional charges. Beds and furniture should NOT be moved from the room you find them in. This includes dirty dishes in the kitchen – there is a dishwasher. We allow 3 hours for a clean after each stay, additional time spent cleaning will be charged at $50 plus GST per hour.
SHOES
Please remove your shoes before entering the cottage.
LOST KEY POLICY
Keys that are not returned will be charged to the credit card supplied. A $25 charge will apply if keys are lost.
SMOKING
All rooms are non-smoking inside. Any traces of residual smoke inside will incur an additional cleaning charge of $200. Any additional costs of cleaning soft furnishings may be added as deemed necessary by management.
PETS
EARLY DEPARTURE
No refunds will be given on early departure and any outstanding balance will be deducted from the credit card provided.
TRADING TERMS
Heartwood Farm Byron Bay reserves the right to release any booking if payment terms are not met.
FORCE MAJEURE
Heartwood Farm Byron Bay will not be in breach of this agreement, or in any way liable to any party, if it is prevented from complying with this agreement by reason of act of God, the act of public enemy, the act of terrorism, war, earthquake, riot, explosion, compliance with any law or government restraint order, rule regulations, strike, lockout or any other cause not reasonably within the control of Heartwood Farm Byron Bay.
The owner will make every effort to ensure the property is available as booked and is in good working order and cannot be held responsible for any; force majeure that prevents the guest from occupying the property, loss of service to the property by utilities, principally electricity, the failure of third party suppliers to provide services to the property as agreed to, or loss of any amenity of the property and accordingly there will be no refund in part or full of the rental amount paid in such circumstances.
PRIVACY POLICY
Heartwood Farm Byron Bay is subject to the National Privacy Principles in the Privacy Act 1988. We will generally collect personal information about you directly from you when you deal with us over the telephone or by letter or e-mail. Normally, the type of personal information collected by us will include your name, address, telephone number and e-mail address. We may use your personal information for some or all of the following purposes:
- To provide marketing information to you about our products and services;
- To monitor the standard and quality of service we provide to your or other guests.
If you do not wish to receive these communications from us, you may unsubscribe. If you choose to send email messages to us that contain confidential, private or personal information, you do so entirely at your own risk.
GOVERNING LAW
The Law of New South Wales governs your use and occupation of the property during this reservation. You agree to submit to the exclusive jurisdiction of the Courts of New South Wales.
COPYRIGHT
The information, text, graphics, images, sounds, links and all other information and software published or otherwise contained on this site (“the contents”) are the exclusive property of Heartwood Farm Byron Bay and, except as authorised on this site, may not be copied, distributed, displayed, reproduced or transmitted, in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of Heartwood Farm Byron Bay.
DISCLAIMER
Heartwood Farm Byron Bay strives to ensure that the contents of this site are accurate and reliable. However errors and/or omissions may occur, Heartwood Farm Byron Bay disclaims any warranty of any kind, whether express or implied, as to any matter whatsoever relating to this website and any links to or from this website, including, without limitation, warranties as to merchantability, non-infringement of intellectual property, or fitness for any particular purpose.
Heartwood Farm Byron Bay does not warrant the accuracy, currency or completeness of the contents, including, without limitation, any information relating to prices or availability. The owner takes no responsibility for the guests’ personal property at any time inside the cottage or on the grounds.
